Dear Customers,

We have discovered a serious breach of data integrity. It has come to our attention that customer data—including contact details and order histories originally provided exclusively to New Direction Tackle Ltd.—has been unlawfully appropriated and is being used by NDS Tackle without our authorization or your consent.

Many of you have already confirmed that when logging into the NDS Tackle website, your full profile and private order history from our shop are already present. This indicates a systematic, unauthorized migration of our database.

We have already reported this to the Information Commissioner’s Office (ICO), and we strongly urge you to take action to protect your personal information and hold those responsible accountable.

Below are the steps and templates you can use to report this to the authorities and demand the deletion of your data.

Evidence Checklist for Customers

To ensure your report to the ICO and the Police is effective, please gather and attach the following evidence:

1. The “Smoking Gun” Evidence (NDS Login):
   • Log into the NDS Tackle website or app (if you have found that an account exists).
   • Take screenshots of your profile page showing your pre-filled personal details (name, address, phone number).
   • Crucially: Take screenshots of the Order History section showing orders you originally placed with New Direction Tackle Ltd.
2. The Source Proof:
   • Locate an original invoice or order confirmation from New Direction Tackle Ltd.
   • This proves that you were an ND Tackle customer and that your data has been misappropriated by NDS.
3. Communication Proof:
   • Save any unsolicited marketing emails or newsletters you received from NDS Tackle as PDFs or screenshots.

 

Template 1: Letter to NDS Tackle

Subject: FORMAL INQUIRY: Unauthorized Data Processing and Objection

Dear Sir or Madam,

I am writing to you as there is a high probability that my personal data (including contact details and order history) is being processed by NDS Tackle without my authorization.

I have never provided consent for my data to be transferred from New Direction Tackle Ltd to your company.

I hereby request the following under UK GDPR:

1. Right of Access: Please confirm whether you are processing personal data concerning me. If so, provide a copy of this data and state the legal basis for its processing.
2. Objection & Erasure: Should you be in possession of my data, I formally object to any further processing and demand the immediate erasure of all my personal data from your systems (Art. 17 UK GDPR).
3. Source of Data: I demand to be informed of the exact source from which you obtained my data.

Please provide a response and confirmation of erasure within 14 days. Failure to do so will result in further escalation.

I have personally verified this by logging into the NDS Tackle website, where I found my full profile and historical orders from a different company already present in their database. This indicates a systematic, unauthorized transfer of a customer database.

To the Duty Officer,

I am reporting a criminal matter regarding the unauthorized misappropriation of my personal data by NDS Tackle (First Floor Oceana House, 39-49 Commercial Road, Southampton, SO15 1GA).

Statement of Fact: I have discovered that my sensitive personal data, including my private order history from another company (New Direction Tackle Ltd.), has been unlawfully migrated into the database of NDS Tackle. I have verified this by accessing their system and finding my private records pre-populated.

I did not authorize this transfer, nor did I provide NDS Tackle with my data. This appears to be a breach of the Computer Misuse Act 1990 (Section 1) regarding unauthorized access to computer material.

I am requesting that this be investigated as a criminal data theft. I have already informed the ICO (Ref: IC-427818-D0K5).
